Laws and rules exist to govern our society and ensure a civil and safe environment for all, and it extends to cover sexual activities as well.
So it’s good to know what the rules are in Singapore. Legally Speaking Laws that deal with sexual offenses are detailed under the penal code in the Singapore Statutes. Age of consent In Singapore, the age of consent for sexual activity is 16. This means it is illegal to have sex with anyone under the age of 16, even if consent is given. Rape Rape is a serious offense in Singapore. Any man who penetrates the vagina of a woman with his penis without her consent, or does so to a woman under 14 years of age, with or without consent, is guilty of rape, as per Section 375 in the penal code. Rape is punishable by imprisonment of up to 20 years, including a fine or caning. Sexual assault by penetration While Section 375 on rape specifically deals with coerced sexual penetration by a man on a woman, other instances are covered under sexual assault by penetration in Section 376. Any person (man or woman) who coerces another person into penetrative sexual acts without consent, can be sentenced to an imprisonment term of up to 20 years, and shall also be liable to fine or caning. The punishment is increased to include imprisonment between 8 to 20 years and 12 strokes of the cane if the victim involved is less than 14 years of age. Incest In Singapore, it is an offense for any man of or above 16 years old to sexually penetrate a woman, whom he knows is his grand-daughter, daughter, sister, half-sister, mother or grandmother, whether with or without consent. The offense carries a prison term of up to 5 years. If the victim is a woman under 14 years of age, the prison term may extend to 14 years. The same applies vice versa for women. It is illegal for any woman of or above 16 years old to consent and permit her grandfather, father, brother, half-brother, son or grandson to sexually penetrate her while knowingly aware of the familial relation between them. Outrage of modesty Section 354 of the penal code also states that a person who assaults or uses criminal force on another person with the intention to outrage his or her modesty (or more commonly known as molestation) is punishable by law. The punishment is more severe for cases where the victim is under 14 years of age. Commercial sex Section 376B – D also specifically outlaws commercial sex with minors under 18 of age, whether within or outside Singapore. It is also illegal for anyone to make or organise any travel arrangements with the intention of engaging in commercial sex with minors under 18 outside Singapore. Polygamy According to the Women’s Charter, it is an offense to be lawfully married to more than one spouse. Oral and anal sex With the recent amendment, oral and anal sex is now legal in Singapore if it is between consenting adult heterosexuals. Pornography and obscene material The law in Singapore also prohibits the possession of any material (including books, pamphlets, drawings, paintings, representation or figure, or object) that is obscene . While it is hard to define what obscene material is, the Undesirable Publications Act in Singapore defines it is as any material (comprising 2 or more distinct portions) seen, read or heard in part or as a whole, that would likely corrupt and deprave a person. A person in possession of such items is punishable by imprisonment of up to 3 months, or with fine, or both.
